Letting a property safely and legally means juggling a dozen separate certificates, checks and duties — each with its own renewal cycle and its own penalty for getting it wrong. Miss one and you can face fines running into tens of thousands of pounds, and lose your ability to regain possession. This guide lists every core legal requirement for letting a property in England, how often it renews, and what happens if you don't comply. A printable checklist is at the end.
(Scotland, Wales and Northern Ireland have separate rules — check the relevant national guidance.)

The core legal requirements
1. Gas Safety Certificate (CP12)
- What: An annual safety check of all gas appliances, pipework and flues by a Gas Safe registered engineer.
- Frequency: Every 12 months.
- Tenant copy: Give existing tenants a copy within 28 days of the check; give new tenants a copy before they move in.
- Penalty: Substantial fines (commonly cited up to ~£6,000 per breach) and possible prosecution; in serious cases, unlimited fines and imprisonment.
2. Electrical Installation Condition Report (EICR)
- What: A safety inspection of the property's fixed electrical installation by a qualified electrician.
- Frequency: At least every 5 years (or sooner if the report specifies).
- Action: Remedial work for any C1/C2/FI codes must be done within 28 days (or sooner if stated), with confirmation supplied to the tenant and, on request, the local authority.
- Penalty: Local authorities can fine up to £30,000 for non-compliance.
3. Energy Performance Certificate (EPC) & MEES
- What: A valid EPC rating the property's energy efficiency, given to tenants before letting.
- Frequency: Valid for 10 years.
- Current minimum (MEES): You generally cannot let a property rated F or G (minimum is band E), subject to exemptions.
- Coming change: Most privately rented homes in England and Wales must reach EPC band C (or equivalent) by 1 October 2030. The earlier proposal for a 2028 "new tenancies" deadline was dropped in favour of a single 2030 date. Budget and plan upgrades now.
- Penalty: Fines for letting below the minimum standard (commonly cited up to £5,000+ depending on breach; higher penalties proposed under the EPC C regime).
4. Tenancy Deposit Protection
- What: Protect any deposit in a government-approved scheme (TDS, DPS or mydeposits) and serve the tenant the prescribed information.
- Deadline: Within 30 days of receiving the deposit.
- Penalty: Compensation of 1–3× the deposit to the tenant, and you cannot serve possession notices that rely on a protected deposit until it is sorted. (Note: with Section 21 abolished from 1 May 2026, deposit rules now bear on Section 8 routes and overall compliance.)
5. Right to Rent checks
- What: Check every adult occupier has the legal right to rent in the UK before the tenancy starts, and follow up time-limited rights.
- Frequency: Before tenancy start; re-check where a right is time-limited.
- Penalty: Civil penalties up to £10,000 per lodger / £20,000 per occupier for a repeat breach (rates increased 22 January 2024); knowingly renting to a disqualified person is a criminal offence.
6. Smoke & Carbon Monoxide Alarms
- What: A smoke alarm on every storey with a room used as living accommodation, and a carbon monoxide alarm in every room with a fixed combustion appliance (e.g. a gas boiler or wood burner — gas cookers are excluded). Alarms must be tested and working at the start of each new tenancy.
- Frequency: Check at every tenancy start; repair/replace promptly when reported faulty.
- Penalty: Local authority fine up to £5,000 for failing to comply with a remedial notice.
7. HMO Licensing
- What: A licence for Houses in Multiple Occupation. Mandatory licensing applies to HMOs with 5 or more people from 2+ households sharing facilities. Many councils also run additional and selective licensing schemes covering smaller properties — always check with your local authority.
- Frequency: Typically renewed every 5 years (varies by council).
- Penalty: Unlimited fine for operating an unlicensed HMO (commonly enforced via civil penalties up to £30,000), plus possible Rent Repayment Orders.
8. The 'How to Rent' guide
- What: Give every new tenant the current government How to Rent checklist at the start of the tenancy.
- Frequency: At tenancy start and on renewal if the guide has been updated.
- Penalty: Affects your ability to use certain possession routes; a cheap, essential box to tick.

5 key takeaways
- Gas (yearly) and EICR (5-yearly) are non-negotiable and carry the heaviest safety penalties.
- Protect deposits within 30 days and serve prescribed information — late protection is costly and blocks possession.
- EPC band C by October 2030 is the big capital-spend deadline — start budgeting now.
- Carbon monoxide alarm rules widened in 2022 to cover any room with a fixed combustion appliance, not just solid-fuel.
- New duties are coming — PRS Database (from 15 December 2026), Ombudsman (~2028) and Awaab's Law — keep your records clean and ready.
Every certificate has a different renewal date — and missing one is expensive. Lettfolio tracks every one of these deadlines and reminds you before they expire, so you never get caught out. Start free at lettfolio.uk.
